Job board terms

Version 2. An annex to the Tasker terms of service. Where this document is silent, the terms of service apply.

The Polish version of these terms is binding. This translation is provided for convenience only. If the two differ, the Polish version prevails.

Definitions

In these terms a few words have a fixed meaning:

  • A manager is an organisation with a Tasker account that manages property professionally or as part of its business.
  • A contractor is a business with a contractor account in Tasker.
  • Content means a listing, an offer, a review, a reply to a review and a message.
  • A conversation is an exchange of messages between a contractor and a manager about one listing.
  • Support means the Tasker staff.

1. What the job board is

The job board is a notice board inside Tasker. A manager posts a listing for work that needs doing, and a contractor sends an offer. The manager picks one offer or none.

2. Tasker's role

Tasker provides a tool for getting in touch and stores the content users enter. Beyond that:

  • Tasker is not a party to the contract between the manager and the contractor. They conclude it themselves, on terms they agree themselves.
  • Tasker does not check the quality of work, the qualifications, the insurance or the solvency of either side.
  • Tasker does not handle payments and does not take money for jobs.
  • Tasker does not guarantee that a listing will receive offers, that a job will be done or that it will be paid for.
  • Tasker does not choose the contractor. The "Tasker Partner" badge next to an offer means only that the contractor is affiliated with the operator of Tasker or has a cooperation agreement with it. It is not a recommendation or a guarantee of quality, and it does not change the order of offers. The usterka.pl service is run by the same company as Tasker.

Tasker is liable for the operation of the job board as set out in the terms of service. It is not liable for the performance of the contract between the manager and the contractor, for the content of offers, listings, reviews and messages, or for damage caused by the other party to a job. This does not exclude liability for damage caused intentionally.

3. What Tasker shows about the contractor and the manager

Next to an offer, the manager sees only what follows from data held in the service:

  • The tax number (NIP) given by the contractor. A note that it was checked in a register appears only if the manager has checked that number in the company register on their own contractor list.
  • The list of documents and qualifications, if the contractor agreed to show it. This is information declared by the contractor. Tasker does not verify it and does not see the documents.
  • Reviews of the contractor written by managers under section 8. Tasker does not check whether a review is true.
  • The "Tasker Partner" badge, where it applies to the contractor (section 2).

Next to a listing and in a conversation, the contractor sees the following about the manager: the town, the year since which the manager has used Tasker, the range of the number of units managed (up to 20, 21–100, 101–500, over 500) and reviews written by contractors. The contractor does not see the manager's name. This information may nevertheless make it possible to recognise the manager, especially in a smaller town. Tasker does not promise the manager anonymity.

Before entrusting the work, the manager should check the contractor's qualifications and insurance themselves.

4. Who can use it

The job board is intended only for businesses and other organisations acting professionally. A private individual who rents out their own flat outside any business activity may not use it. The job board is not intended for consumers.

Listings are posted by the manager. By accepting these terms you declare that you act on behalf of an organisation that manages property professionally or as part of its business, and that you are entitled to represent it in this respect. The terms are accepted by a member of the organisation's team, and that acceptance binds the whole organisation.

Offers are sent by a contractor who has their own contractor account and runs a business. The job board is open to every such contractor. To send an offer, the contractor must have a name and a tax number (NIP) in their profile. Tasker may ask for confirmation of these details and refuse access to the job board if they cannot be confirmed.

5. The listing

A listing contains the category, a description of the work, photos, the area (postcode and town) and the expected date. It does not contain the exact address, the manager's name or the tenant's details. The manager's name is disclosed only to a contractor the manager has invited themselves (section 17).

  • The description and photos must not include contact details, the address, surnames or other personal data. Photos showing faces, name plates or flat numbers must be left out.
  • Before a listing reaches contractors, support reads it and checks that it does not contain contact details, personal data or prohibited content listed in section 11. This usually takes until the end of the next working day.
  • Support does not assess the scope of work, the price or the manager's reliability. Approving a listing does not mean that Tasker confirms what it says.
  • Support does not approve a listing that breaches these terms. The manager receives a statement of reasons and can appeal (section 14).
  • A listing can be posted when there are at least 3 contractor accounts in its category and area.
  • A listing is valid for as many days as the manager chooses, 7 at most, counted from the day support approved it. Unless the manager chooses otherwise, it is 7 days. After that the listing expires on its own.
  • A listing can receive no more than 5 offers.
  • The manager can withdraw a listing at any time before choosing an offer.
  • By posting a listing, the manager accepts questions from contractors about that listing (section 18).

6. The offer

An offer contains the price (an amount, a range, or a note that the price will be known after an inspection), the date and a comment. Contact details must not be given in an offer. A contractor sends one offer per listing and can withdraw it until the manager has chosen an offer. A withdrawn offer cannot be sent again. The price in an offer is the contractor's proposal. The final terms are agreed between the parties.

7. Choosing an offer

Once an offer is chosen, Tasker creates an ordinary job and shows the chosen contractor the address and, unless the manager turns this off, the contact details of the person who reported the issue; the manager is shown the contractor's phone number and email address. The other contractors receive a message that the listing has been closed. The manager is not obliged to choose any offer.

The contractor receives the address and contact details solely in order to carry out the job. The contractor may not use them for any other purpose, in particular to send offers to the tenant. From the moment they are handed over, the contractor is responsible for this data as its controller.

8. Reviews

A manager can write a review of a contractor, and a contractor can write a review of a manager. A review consists of a rating from 1 to 5 and an optional comment of up to 600 characters.

  • A review can be written when the two parties have had a job in Tasker that was marked as done, or when both parties confirmed on closing a conversation that they did work together (section 18). Tasker does not check whether a review is true.
  • Each party writes one review of the other, however many jobs they have had together.
  • A review describes facts from the cooperation: punctuality, communication, whether the work matched what was agreed, payment. The comment must not include contact details or personal data. The same automatic filter applies as for offers.
  • A review can be changed at any time. A changed review is marked with the date of the change. We keep earlier versions but do not show them.
  • The reviewed party can reply to a review once (up to 600 characters). The reply is shown under the review. If the author changes the review, the reply disappears and the reviewed party can write a new one.
  • Reviews of a contractor are visible to managers next to the contractor's offers. Reviews of a manager are visible to contractors next to the manager's listings and in a conversation with the manager. We do not show the name of the author. The other party may, however, guess who wrote it.
  • We show an average rating once the reviewed party has at least 3 reviews. It is a plain arithmetic mean. The number of reviews is shown next to it.
  • Tasker does not remove a review because it is negative.
  • Tasker sends one email reminder about a review: 14 days after the job was marked as done, or 14 days after both parties confirmed that they worked together.
  • Reviews that are untrue, given in exchange for a benefit or written in retaliation are not allowed. Payment or performance of the work must not be made conditional on what a review says.
  • Every review and reply can be reported (section 12). The author is responsible for the content.
  • When the account of the author or of the reviewed party is deleted, we delete the review together with the reply.

9. Display order

Tasker does not sell positions in a list and does not promote anyone for a fee.

  • The list of listings shown to a contractor: listings marked as an emergency first, then newest first. By default the contractor sees listings from the area and categories saved in their profile. One click shows all of them.
  • The list of offers shown to a manager: lowest price first (for a range, the lower amount counts), offers priced after inspection last, and at the same price the earlier offer is higher.
  • The review rating and the "Tasker Partner" badge are shown next to an offer but do not change the order.

10. Fees

Using the job board is free for the manager and for the contractor. Tasker charges no commission, does not handle payment and does not collect information on whether or how much the manager paid the contractor. The price shown in an offer is the contractor's proposal as of the day the offer was sent.

11. Prohibited content

The following are not allowed:

  • content that is against the law,
  • contact details and personal data in listings, offers, reviews, replies and messages,
  • content that misleads about identity or qualifications,
  • sham offers and listings,
  • reviews that are untrue, given in exchange for a benefit or written in retaliation,
  • messages and invitations sent in bulk or for a purpose other than the one they are meant for,
  • abusive content.

A critical review that describes facts is not prohibited content.

12. Reporting content

Every listing, offer, review and reply to a review, and every conversation, has a link for reporting content. A person without an account can report content by email to the contact point (section 21).

A report sent by email should include:

  • what the content is: the listing number or a description of where it can be found,
  • an explanation of why the content is against the law or these terms,
  • the name of the person or organisation reporting and their email address,
  • a statement that the report is made in good faith and that the information in it is accurate and complete.

What happens next:

  • The person reporting receives a confirmation with a case number and, once the case is decided, information about the decision and how to appeal against it. The full statement of reasons goes to the author of the content.
  • Reports are handled by a human. Tasker does not make these decisions automatically.
  • The only automated tool that assesses content is a filter. On saving, it blocks phone numbers, email addresses and web addresses in a listing, offer, review, reply and message. The author sees at once what was blocked and can correct the text.

13. Decisions and suspension

Tasker may refuse to approve a listing, remove content or suspend a manager's or a contractor's participation in the job board when content is against the law or these terms. This applies in particular to giving contact details or personal data despite the block, misleading others, sham offers and listings, untrue reviews, bulk messages and invitations, and misuse of reports.

  • A suspension has no end date and lasts until it is lifted. After 6 months the suspended party can ask for the case to be looked at again. This does not affect the right to appeal under section 14.
  • The author of the content receives a statement of reasons by email: what the decision concerns; what was decided, to what extent and for how long; which facts we took into account; whether the case started with a report or on our own initiative; whether an automated tool was used; on what grounds (a legal provision or a section of these terms, with an explanation of why the content breaches it); how to appeal, where to lodge a complaint, and that the matter can be taken to court.
  • The person who reported the content is informed of the decision and of the right to appeal (section 12).
  • We do not tell the author who reported the content, unless the case cannot be handled otherwise, for example when the report concerns an infringement of the reporting person's own rights.
  • A suspension covers the job board only. Issue reports, jobs and the other Tasker features keep working, and jobs already accepted can be completed.
  • A suspension closes the suspended party's open listings or offers.
  • When content points to a criminal offence that threatens the life or safety of people, we notify the police or the public prosecutor.

14. Appeal

A decision can be appealed by the author of the content it concerns and by the person who reported the content. The time limit is 180 days from the day the decision was received. An appeal is made by replying to the message containing the decision or by writing to the contact point.

An appeal is handled by a human, never by an automated tool. We reply within 14 days, with reasons. If the appeal is justified, Tasker restores the content or the access without delay. An appeal is free of charge.

Regardless of an appeal, the matter can be taken to court, and a complaint about a breach of the rules on digital services can be lodged with the President of the Office of Electronic Communications (Prezes Urzędu Komunikacji Elektronicznej).

15. Personal data

The privacy policy describes how data is processed. A listing does not contain the tenant's details or the address. Only the contractor chosen by the manager sees the address and contact details.

An invitation to a contractor outside Tasker is sent by the manager in the manager's own name and as the controller of the recipient's data. Tasker sends it technically, on the manager's instruction (section 17).

16. Changes to these terms

We announce a new version of these terms by email and in the service at least 15 days before it takes effect, and we say what is changing. We use a shorter notice period only when the change is required by law or by a decision of an authority, or when it adds a new feature and does not limit existing rights.

A new version must be accepted the next time a listing is posted or the job board is opened. Without acceptance it is not possible to post listings or send offers. Jobs already accepted can be completed under the previous rules. Earlier versions remain on record and are available on request.

17. Inviting a contractor from outside Tasker

A manager can invite a contractor who has no account to send an offer, by entering the contractor's email address. An invitation can be sent only for a listing that support has approved.

  • The invitation is the manager's request for an offer. Tasker sends it technically, on behalf of the manager and on the manager's instruction. A reply to that email goes to the manager.
  • The email states the manager's name, the category of work, the town, the date and a link to the listing. By sending an invitation, the manager agrees that the recipient will learn the manager's name.
  • The manager enters only the addresses of contractors they already work with or who have themselves published that address for contact about jobs, for example on their website, in a company register or on a business card. The manager is responsible for having the right to use the address for this purpose and confirms it with a declaration before every sending.
  • We send one invitation per address for a given listing. We do not send reminders or any other messages to people who have not created an account.
  • No more than 10 addresses can be invited to one listing. An organisation can send no more than 30 invitations a day. We send no more than 3 invitations to one address within 30 days, counting invitations from all organisations.
  • Every invitation contains a link with which the recipient blocks further invitations from Tasker in one click. The block is permanent and applies to all managers. The block list does not hold the address itself, only a hash of it computed with a secret key.
  • The manager sees only how many invitations were sent and how many were skipped. We do not say which addresses were skipped or why.
  • We delete the invited person's address 90 days after the listing is closed.
  • If the address entered belongs to a contractor who already has an account, the contractor receives an ordinary Tasker message about the request.
  • Invitations must not be used for advertising, bulk mailing or contact for any purpose other than a request for an offer.

The manager can also copy the link to the listing and send it to a contractor from their own mailbox. The manager sends such a message independently and is solely responsible for it.

18. Questions about a listing

A contractor can ask the manager a question about an open listing. The manager does not switch this on separately: by posting a listing, the manager accepts questions about it. A contractor has one conversation with the manager per listing.

  • The contractor does not know the manager's name. The contractor sees about the manager what section 3 describes.
  • One contractor account can start no more than 5 new conversations a day.
  • After the first message the contractor waits for the manager's reply. Once the manager replies, both parties write without this restriction.
  • A message can be up to 1000 characters long. It must not include contact details. The same automatic filter applies as for offers.
  • We notify about a new message by email, without its content.
  • Either party can close the conversation at any time and report it to support (section 12).
  • When closing a conversation, each party answers whether they worked together. Once both parties confirm it, they can review each other (section 8).
  • Support does not read conversations. The exception is a conversation reported by one of the parties or examined at the request of a competent authority.
  • We delete a conversation together with the listing, that is 90 days after the listing is closed. If a case arising from a report or an appeal is pending, we keep the conversation until the case ends.
  • A conversation is for clarifying the listing. It must not be used to send advertising or bulk messages.

19. Email notifications

Tasker sends emails related to the job board only in the cases described below.

  • We write to a contractor about new listings only with the contractor's consent. By default this is one digest a day. The contractor can switch to notifications sent immediately.
  • We write about a listing marked as an emergency immediately, even if the contractor chose the daily digest.
  • Every such email has a link that turns off notifications about new listings in one click.
  • Apart from that, we write about matters concerning a particular user: a new offer, the choice of an offer, the closing of a listing, a new message in a conversation (without its content), a decision by support and, once, a reminder about a review.

20. Language, law and court

These terms are drawn up in Polish and are binding in that version. Translations are provided for convenience. If they differ, the Polish version prevails.

The interface in other languages may be machine-translated and may contain errors. Users' content is shown in the language in which it was written. You can communicate with support and the contact point in Polish and in English. Decisions and statements of reasons are also sent in those languages.

Use of the job board is governed by Polish law. Disputes between Tasker and a user of the job board are settled by the court with jurisdiction over the registered office of the operator of Tasker. The contract between the manager and the contractor, including the governing law and the court, is for the parties to agree.

21. Contact point

The address of the contact point is given below these terms on the service website. It is the contact point for the authorities of the Member States, the European Commission and users. You can write in Polish and in English. A human replies. The same address receives content reports, appeals and requests concerning personal data related to the job board.

22. Ending your use of the job board

You can stop using the job board at any time: simply stop using it or delete your account. Before that, a manager can withdraw their listings and a contractor their offers. Deleting the account closes open listings and offers. Jobs already accepted can be completed. Reviews written by the user and reviews about the user are deleted together with the account (section 8).
